We at Motivating Moments LLC understand that the Internet presents an opportunity for us to reach the public in new and exciting ways. Motivating Moments LLC also recognizes the privacy concerns of parents and the importance of protecting the privacy of the information we collect from children on our website. Parents of children can be confident that any personal information that may be provided to our web site will be collected and maintained in accordance with the Children’s Online Privacy Protection Act (“COPPA”). Motivating Moments LLC encourages parents to supervise their children’s activities online and to participate in their children’s online activities whenever possible.

Collection and Use of Personally Identifiable Information from Children Under 13

When a visitor to our Site is under the age of 13, Motivating Moments LLC does not require the disclosure of more personally identifiable information (“PII”) than is reasonably necessary for him or her to participate in an activity as a condition of such participation.

Use of a Child’s Information by Motivating Moments LLC

We may collect a child’s email address in connection with a submission of a quotation/story or poem for the sole purpose of communicating with the child on a one-time-only basis This information will not be used to re-contact the child and will be deleted from our records.

We may collect a child’s email address in order to respond more than once to a child’s specific request. For example, the child may want to receive other online communications from Motivating Moments LLC. In these instances, Motivating Moments LLC will also obtain a parent’s email address along with the child’s. Before any further contact with the child, Motivating Moments LLC will send an email to the parent (a) notifying him or her we have collected the child’s email address in order to respond more than once to the child’s request for a subscription, information, etc; (b) informing the parent that he or she can refuse us permission to contact the child, and how to do so; and (c) informing the parent that if he or she does not respond to the email within 72 hours, Motivating Moments LLC may use the child’s information for the purpose for which it was submitted.

We may collect a child’s PII (including name, email address, state/province, and age) for such activities as requests for suggestions, subscription registrations, content submissions, or requests for additional information. In these instances, we will initially collect only the child’s name and online contact information, and the email address of the child’s parent. Before using this information for any purpose, we will send the parent an email that (a) informs the parent that we wish to collect and use the child’s personal information and need the parent’s consent to do so, and (b) provides the parent with a link to access to this Privacy Policy, which describes our information collection and use policies as required by COPPA. If the proposed use of the child’s personal information does not involve disclosure to a third party, then Motivating Moments LLC will ask the parent to provide consent by return email. Upon receipt of the email consent, we will send the parent a confirming email. If the proposed use of the child’s PII involves disclosure to third parties, the email we send to the parent will ask the parent either to (i) return by postal mail or fax a consent form that will be attached to the email, or (ii) call our office number where consent can be given over the phone. If parental consent is not obtained by one of these methods within one week, Motivating Moments LLC will delete all of the child’s and parent’s PII from its records. In addition, parents can revoke prior consent at any time.

We may collect a child’s name and email address to the extent reasonably necessary to protect the security of this Site, to protect against liability or as required or permitted by law. Information collected for these reasons will not be used for any other purpose.

Sharing Children’s Personal Information With Third Parties.

Motivating Moments LLC will not share your child’s information with any third party. As noted above, parents may exercise their option not to consent to the disclosure of their child’s PII to third parties. Parents may consent to Motivating Moments LLC’s collection and use of a child’s PII without consenting to the disclosure of the information to third parties.

Links/Co-Branded Sites

As noted in the Privacy Policy, our websites may link directly to sites operated by third-party advertisers, business partners, and affiliated companies. Those sites, which are not controlled by Motivating Moments LLC, may collect PII from your child. Parents should therefore check the relevant site’s privacy policy to understand how it collects and uses children’s personal information. Motivating Moments LLC will not share in any personal information obtained by a site from a child under the age of 13 unless that site follows the requirements of COPPA.

If you would like to know whether we have collected personal information about your child, please provide us with the activities that he or she participated in one of our websites that requested personal information. After reviewing the relevant databases, we will confirm whether we have collected such information about your child.

If you fail to include the necessary information listed above and fail to do so even after initial contact from Motivating Moments LLC, the complaint will be deemed legally null and void.

Motivating Moments LLC Response to Copyright Infringement Notice

Once Motivating Moments LLC receives a Copyright Infringement Notice, the information sent will be examined carefully to be sure all necessary information has been included. If the required information is not included in this email, Motivating Moments LLC will make a reasonable attempt to contact you to retrieve the missing information. If contact cannot be made or you fail to provide the required information within a reasonable time, the notice will be disregarded.

If all necessary information has been provided, Motivating Moments LLC will temporarily remove the infringing material from public access. This protects Motivating Moments LLC from all legal liability. As soon as the material is removed from public access, the author of this material will be notified immediately. b. State, under penalty of perjury, that the material was removed from public access by Motivating Moments LLC as a result of a mistake or misidentification of the material

c. State that you consent to the legal jurisdiction in the federal district court where the user’s address is located

d. State that you agree to accept service of legal process from the copyright owner or person who signed the Copyright Infringement Notice

e. Sign your Full Name (First and Last)

Step 3 – Email all of this in one complete email to motivateus-help@MotivateUs.com with the subject heading of Counternotice.

If you fail to include the necessary information listed above and fail to do so even after initial contact from Motivating Moments LLC, the counternotice will be deemed legally null and void and the material will remain unavailable from public access.

After the Counternotice

When Motivating Moments LLC receives a Counternotice with all of the necessary information, the copyright owner or sender of the Copyright Infringement Notice will be sent a copy of the Counternotice and informed that the disputed material will be replaced to public access no later than ten (10) business days. In order to prevent this from happening, the copyright owner or sender of the Copyright Infringement Notice must bring a court action.

The copyright owner or sender of the Copyright Infringement Notice must convince a judge that copyright infringement has occurred. A Copyright Infringement lawsuit will need to be filed in federal court against the accused author and the court will need to be persuaded that the author is indeed committing copyright infringement.

If the copyright owner or sender of the Copyright Infringement Notice does not want to go to court, the material will be replaced for public access.
